Medical malpractice occurs when a doctor, hospital, nursing home or other health care provider fails to exercise the minimum level of care and skill required in a particular medical situation. Although most doctors and nurses provide excellent care, medical negligence does occur and often with catastrophic consequences. According to the Institute of Medicine of the National Academies, 44,000 – 98,000 people die each year from preventable medical errors and as many as 1,000,000 are seriously injured.

One purpose of medical malpractice lawsuits is to hold healthcare providers accountable to maintain the integrity of our healthcare system. Another purpose is to put patients back in the position that they would have been in had no malpractice occurred.
