Medical malpractice occurs when a doctor, hospital, nursing home or other health care provider fails to exercise the minimum level of care and skill required in a particular medical situation. According to the Institute of Medicine of the National Academies, 44,000 – 98,000 people die each year from preventable medical errors and as many as 1,000,000 are seriously injured.

Another purpose is to put patients back in the position that they would have been in had no malpractice occurred.
